Yet the restorative justice advocate is reluctant to assume even that the the fundamentals of restorative justice tyranny of genocidal warfare or rape is always or generally best responded to punitively. For this restorative justice theorist at least, however grave the injustice, it is best first to explore the possibilities for a restorative resolution. On this view, we are best to be presumptively restorative and punitive only as a last resort. The world has changed a lot, even since Hitler’s time, in a way that means our restorative traditions are more valuable to us than our retributive traditions.

At the same time, adaptability can also become a source of injustice. 28 Women accused of adultery have been imprisoned while their male accomplices have gone unpunished. Likewise, children have reportedly been locked up for minor offences. These abuses have attracted considerable criticism, not least from women’s groups and human rights advocates. In this situation, Village Courts have become overly responsive to local power structures that are almost invariably dominated by older men. In the process, they have served to compound the grievances of the least powerful groups in the community, notably women and children.

Restorative justice has the potential for working with, and through, the relationships and social networks that are such an important feature of Melanesian communities. Peni Moore describes the innovative work of a nongovernment organisation, Women’s Action for Change (WAC), in the Fiji prison system. It is the story of a successful partnership between an NGO and a state agency and shows that restorative strategies can have an impact even inside explicitly retributive institutions. As in most prisons in the region, resources for rehabilitation programs in Fiji are extremely limited.
